The UK defacto visa, otherwise known as unmarried partner visa, which allows an unmarried partner to remain or enter in the UK on the basis that they are in a living relationship with someone who is settled or currently living in the UK. The unmarried partner visa is applicable to both same sex and heterosexual relationships. However, you need to prove that you both are being in the relationship for two or more years. If the unmarried partner visa is granted, then the person can be able to work in the UK.

The eligibility requirements of a UK defacto visa include:

  • You should satisfy the English language requirements
  • You and your living relationship partner must be above 18 years
  • Your living relationship partner should earn at least £18,600 per annum and he or she can be able to sponsor you with that income. If you have children, then the financial requirements will increase
  • You and your living relationship partner should intend to live together on a permanent basis
  • You should have suitable accommodation for you, your partner and any dependents
  • If you and your living relationship partner were involved in any other relationship, you both must show that the relationship you were involved has ended
  • You and your living relationship partner should have enough funds to live in the UK without claiming public funds
  • You and your living relationship partner must show that you both are living together at least for two years similar to marriage. You must show document proof to confirm this
